1. Agreement to Terms
By accessing or using the My Glow Up platform ("Service"), operated by ProBuilder Software ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
My Glow Up is a software-as-a-service (SaaS) platform that provides beauty product recommendation tools for pharmacy retail staff. The Service includes a web-based application, product database, staff management tools, and analytics dashboard.
3. Eligibility
The Service is intended for use by authorized pharmacy retail businesses and their staff in Canada. You must be at least 18 years of age and authorized to act on behalf of your organization to subscribe to the Service.
4. Accounts and Access
Access to the Service requires a store access code provided upon subscription approval. Individual staff members authenticate using an email address and PIN. You are responsible for maintaining the confidentiality of your store access code, staff credentials, and any activity that occurs under your account.
Store managers are responsible for managing staff access and must deactivate accounts for staff who leave the organization.
5. Subscription and Payment
The Service is offered on a monthly subscription basis with the following tiers:
- Single Store: $300/month (up to 10 users)
- Regional: $200/month per store
- National: $125/month per store
All subscriptions begin with a 30-day free trial. A valid credit card is required at the time of signup. If not cancelled before the trial ends, your card will be charged automatically. Payments are processed securely through Stripe. All fees are in Canadian dollars and subject to applicable taxes.
6. Database Updates and Maintenance
Your subscription includes two (2) free database updates per year. Database updates include adding new products, brands, or adjusting recommendations. Additional updates are available at preferred rates. All update requests must be organized into a single correspondence per update to ensure efficient implementation.
7. Cancellation and Refunds
You may cancel your subscription at any time. Upon cancellation, your access will continue until the end of the current billing period. No partial refunds are issued for unused portions of a billing period. To cancel, contact us at fastest.quotes@gmail.com.
8. Silent Alert System
The Service includes a silent alert system designed for loss prevention. Staff can trigger alerts to notify other team members of suspicious activity, potential theft, or distraction tactics on the store floor. The following terms apply:
- Alerts are intended for legitimate loss prevention purposes only
- All alerts are logged with the sender's identity, timestamp, alert type, and store location
- Only managers can acknowledge and silence active alerts
- False alarm designations are recorded and visible in alert history
- Misuse of the alert system (false reports, harassment, or retaliation) is grounds for account deactivation
- ProBuilder Software is not liable for any actions taken by store staff or management in response to alerts
9. Push Notifications
The Service uses web push notifications to deliver time-sensitive alerts (such as silent alerts) to staff devices. By enabling notifications, you consent to receiving push notifications from the Service. You may disable notifications at any time through your browser or device settings. Disabling notifications may prevent you from receiving critical store alerts.
10. Inventory and Cycle Count
The Service includes inventory management tools including cycle count, barcode scanning, and inventory reporting. Product quantities, expired, damaged, and missing product data entered by staff are stored in the Service database. Inventory reports generated by the Service are informational and should be verified against your point-of-sale system. ProBuilder Software is not responsible for inventory discrepancies or decisions made based on inventory data.
11. Acceptable Use
You agree not to:
- Share your store access code with unauthorized individuals or organizations
- Attempt to reverse-engineer, copy, or redistribute the product database
- Use the Service for any unlawful purpose
- Attempt to access another store's data or environment
- Interfere with or disrupt the Service or its infrastructure
- Misuse the silent alert system for purposes other than loss prevention
- Use the barcode scanner to collect or export product data for competitive purposes
12. Intellectual Property
All content, software, algorithms, product databases, and design elements of the My Glow Up platform are the exclusive intellectual property of ProBuilder Software. Subscribers receive a limited, non-exclusive, non-transferable license to use the Service during their active subscription.
13. Data Handling
Our collection and use of personal information is governed by our Privacy Policy. By using the Service, you consent to the practices described therein.
14. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. The application includes offline functionality for uninterrupted use during network outages.
15. Limitation of Liability
To the maximum extent permitted by law, ProBuilder Software shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.
16. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. Product recommendations are informational tools to assist staff and do not constitute medical advice. Pharmacist referral flags are advisory — staff should always use professional judgment.
17. Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email to the account holder. Continued use of the Service after changes constitutes acceptance of the revised Terms.
18. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
